Parts of the website (as defined below) and these terms are written in the masculine form for convenience only but apply equally to all genders.
The website www.kg4.co.il (hereinafter: “the Website”) is the exclusive property of Razgal Holdings LTD. (hereinafter: “the Company”). The Website provides, to the extent possible, information about the Company’s hotel, the services it offers, pricing, promotions, and more. Through the Website, users may purchase vacations and/or vacation packages online, as detailed on the Website and subject to the stated terms of sale.
Booking of such vacations/packages (hereinafter: “the Services”) through the Website shall be made as detailed herein. It is clarified that such booking is binding in all respects and is equivalent to booking rooms through any other method, including the Company’s internet/reservations department.,
The guest undertakes to maintain the condition and integrity of the hotel’s rooms, premises, equipment and facilities including items in the rooms, facilities on hotel premises, and bicycles lent for guest use, and assumes full responsibility to any damage caused with relation thereto and for checking them prior to use.
In the case of damage and/or loss of the aforementioned equipment, the guest will be charged for the full value of the damage without the need for proof.
It is clarified that a reservation is not binding on the Company until confirmation is received.
For the purpose of reservations made via the Company’s Website, these shall be considered a remote sale transaction only if all the conditions stipulated in the Israeli Consumer Protection Law, 1981 are met.
The Website is intended for individual private reservations and is not intended for group bookings.
The Company reserves the right to refuse any booking request at its sole discretion and without the need for explanation, and the user shall have no claim and/or demand against the Company in such case.
For hotel stays – an infant is considered a person up to 2 years of age, and a child is considered between 2–12 years of age.
Prices are displayed excluding VAT for bookings made from outside Israel or via a foreign IP address. Israeli residents or Israeli passport holders who book under these rates will be charged VAT upon arrival at the hotel, as required by law. If the reservation confirmation shows VAT as NIS 0.00, this indicates the booking was made from a non-Israeli IP address. In such cases, VAT will be charged at check-in, according to law.
**Website Terms of Use**
2.1 Any user of the Website and/or any purchaser or potential purchaser of services via the Website (hereinafter: “the User”) declares and confirms that he/she is aware of and has read these terms and conditions, understood them, and agrees to be bound by them. The User shall have no claims and/or demands, direct or indirect, against the Company and/or the Website and/or any of its operators, owners, managers, employees, or representatives. 2.2 The User may only use this Website to book or purchase services and/or obtain information. It is expressly prohibited to use any of the Website content, including images, text, or any other information, without prior written consent from the Company’s management, except as permitted herein. Unauthorized use may infringe copyrights or other applicable laws.
2.3 Any person who legally owns a valid credit card from one of the following companies: Visa CAL, Diners Club, American Express, Isracard, or Mastercard may purchase services through the Website. Payment for such reservations is made at the hotel. The credit card serves as a security deposit only to ensure full payment by the GUEST/USER of all of his obligations, and full card details must be provided in accordance with legal requirements.
2.4 The Company is not responsible for the content or nature of any third-party information displayed or published on the Website. The User shall have no claims against the Company regarding such information.
2.5 All images displayed on the Website are for illustration purposes only. Differences may exist between the image and the actual item/room/facility due to display variations.
2.6 The Website may contain links to other websites (“Linked Sites”). These are provided solely for the User’s convenience. The Company is not responsible for the content, validity, or legality of the Linked Sites. Use or access of such links is at the User’s sole risk. Linking or displaying the Website on other platforms requires prior written approval from the Company.
2.7 The Company may, at its sole discretion and without prior notice, modify these Terms, the Website structure, content, appearance, and the scope and availability of services offered. Changes take effect upon publication unless stated otherwise.
2.8 The Company, its operators, owners, managers, employees, or representatives are not responsible for the internet server used by the Website or for any viruses or components that may harm the User’s device. The User shall have no claims in this regard. The Company makes every reasonable effort to prevent such issues.
2.9 The Company is not liable for any damage resulting from delays or failures in Website operation, including while booking or retrieving information.
2.10 The Company is not responsible for any illegal activity performed by users or any third party not under its control.
2.11 The Company may suspend or deny access to any part of the Website to any user at any time. The user shall have no claim in such event.
2.12 Any dispute related to these Terms or the Website shall be governed exclusively by Israeli law and adjudicated solely in the competent courts in Tel Aviv-Jaffa.
**3. Service Purchaser Details**
3.1 A user wishing to purchase services through the Website will be required to enter all necessary details as required by the Website and by law (hereinafter: “Purchase Details”).
3.2 The Company shall not be held liable, directly or indirectly, in the event that the purchase details are not properly received by the system and/or in case of any technical issue preventing the completion of a purchase through the Website.
3.3 The Website owners, operators, managers, employees, or anyone on their behalf shall not be liable for errors made by the user in entering the purchase details, including, but not limited to, errors in selecting the vacation package, dates, number of guests, meals, or any other service ordered. The user confirms that no claims shall be made in this regard.
3.4 Entering false purchase details constitutes a criminal offense. The Company reserves the right to take legal action against those who submit false information, including seeking compensation for damages that may be caused to the Company and/or Website or its operators.
**4. Cancellations and Modifications**
All cancellations or changes to reservation details are subject to the terms stated upon the reservation process made through the KG4 Hotel website and must be made via the Reservations Center at +972-50-3021048 or through the link provided in the booking engine and are subject to Company’s policy and advance written approval.
Any change initiated by the user (such as dates, destination, etc.) may be subject to a price change in accordance with the Company’s policies.
Cancellations or changes made on Shabbat or Israeli public holidays will be considered as submitted on the following business day for the purpose of calculating cancellation fees.
**5. Cancellations by the Company**
The Company reserves the right to terminate/cancel sales on the Website, in whole or in part, at its sole discretion and at any time, including in the following cases:
– Illegal activity detected on the Website.
– False or intentionally incorrect registration details submitted by the user. Submitting false purchase details is a criminal offense and the Company reserves the right to take legal action.
– The user’s credit card is blocked or otherwise restricted.
– Technical or communication issues prevent the booking.
– Force majeure, war, hostility, or terror prevents the continuation of the sale.
– Errors in service description, pricing, or data entry.
– Any breach of these Terms.
In such cases, users will be notified and any pre-paid amount will be refunded. The Company also reserves the right to cancel or modify any order or replace purchased rooms/services with alternatives, in accordance with applicable law.
**6. Discount Code Terms**
Discount codes (“Coupons”) may be used only for prepaid hotel bookings, excluding certain hotels listed with each coupon. Participating hotels may change without notice. Coupons cannot be used across currencies. For multi-room bookings, percentage discounts apply only to the first room.
Only one coupon may be used per booking. Taxes and fees still apply. Coupons hold no cash value and are non-refundable. Single-use coupons will be marked as used once redeemed and cannot be reinstated. Multi-use coupons may expire as defined by their terms.
If the hotel stay is rescheduled after applying a coupon, the coupon will not apply to the new dates. Coupons cannot be used for past bookings. The Company reserves the right to modify or cancel coupon terms at any time.
**7. Prohibited Use**
By using this Website, the user agrees not to use it for any unlawful or unauthorized purpose in violation of these Terms and any applicable law.
**8. Pricing**
Room prices on the Website are as published and may change at any time. Such changes will not apply to already confirmed bookings. Despite best efforts, pricing errors may occur. The Company reserves the right to correct errors and, if necessary, cancel bookings made at incorrect prices.
In such cases, if availability allows, the Company may offer the user the option to maintain the booking at the correct price or cancel it without penalty. The Company is not obligated to honor erroneous lower prices, even after a confirmation is issued.
**9. Modifications**
The Company reserves the right to change or discontinue price commitments or limit availability to any user, at any time, with or without notice. The terms at the time of booking apply. Failure to enforce any provision does not constitute a waiver.
**10. Force Majeure**
The Company shall not be liable for any failure or delay in fulfilling its obligations due to force majeure. “Force majeure” includes events beyond reasonable control such as strikes, lockdowns, civil unrest, fire, flooding, earthquake, extreme weather, war, military operations, epidemics, quarantine, technical malfunctions, etc.—whether foreseeable or not.
In such events, the Company may cancel or change any reservation or substitute purchased services/rooms. Users will have no claim against the Company for any changes or non-fulfillment of obligations resulting from force majeure. Refunds are not guaranteed in such circumstances.
**Note:** All references in these Terms to the masculine gender apply equally to the feminine and vice versa.
